Welcome to Fikarix (www.fikarix.com). These Terms and Conditions govern your use of our platform and services. By accessing or using Fikarix, you agree to these terms. If you do not agree, please do not use our platform.

1. Definitions

✔ “Platform” refers to Fikarix, including its website, mobile apps, and services.
✔ “User” refers to any individual or business using Fikarix (freelancers, clients, or visitors).
✔ “Freelancer” refers to individuals offering services through Fikarix.
✔ “Client” refers to businesses or individuals hiring freelancers through Fikarix.
✔ “Project” refers to any task, job, or assignment posted on the platform.
✔ “Escrow” refers to the secure payment system used for project transactions.

2. Eligibility & Account Registration

✔ Users must be 18 years or older to create an account.
✔ Users must provide accurate and up-to-date information.
✔ Fikarix reserves the right to suspend or terminate accounts for fraudulent activities or policy violations.

🚨 Legal Compliance:

  • Under IT Act, 2000 (India), false identity creation or fraud will result in legal action.
  • Users from countries under trade restrictions (as per applicable laws) may not use Fikarix.

3. Use of Platform & Services

✅ For Clients:

  • Clients may post projects and hire freelancers.
  • Payments must be secured through the escrow system.
  • Clients must clearly define project scope and respond to freelancers promptly.

✅ For Freelancers:

  • Freelancers must deliver work as per project agreements.
  • Quality of work must meet industry standards and client expectations.
  • Freelancers cannot demand upfront payments outside the escrow system.

🚨 Prohibited Activities:
❌ Posting illegal, harmful, or misleading content.
❌ Using fake profiles or misrepresenting qualifications.
❌ Circumventing payments outside Fikarix.
❌ Engaging in fraud, spam, or harassment.

4. Payment & Fees

✔ Fikarix uses an escrow system to ensure secure transactions.
✔ Freelancer Fees: 2-5% commission on completed projects.
✔ Client Fees: No extra charges apart from the project amount.
✔ Payments are released only after client approval of the completed work.
✔ Refunds are processed as per our Refund & Returns Policy.

🚨 Tax Compliance:

  • Users must declare their earnings and comply with local tax laws.
  • GST (Goods and Services Tax) may be applicable for Indian users as per GST Act, 2017.

5. Dispute Resolution

If a dispute arises between a client and freelancer, the process is as follows:

1️⃣ Attempt direct communication for resolution.
2️⃣ If unresolved, file a dispute via Fikarix Support at contact@fikarix.com.
3️⃣ Fikarix will review project details, communication logs, and submitted work.
4️⃣ A decision will be made based on platform policies and legal compliance.

🚨 Legal Disclaimer:
Fikarix acts as an intermediary and is not liable for any contract breaches between users.

6. Account Suspension & Termination

Fikarix may suspend or terminate accounts for:
❌ Multiple policy violations.
❌ Non-payment of freelancer fees.
❌ Fraudulent activities.
❌ Repeated disputes or abuse of platform policies.

Suspended users may appeal within 7 days by contacting support@fikarix.com.

🚨 Legal Compliance:

  • Accounts engaging in fraudulent activities will be reported under IT Act, 2000 (India).
  • Users violating data protection laws will face action under GDPR (EU) & CCPA (US).

7. Intellectual Property Rights

✔ Users own the rights to the work they create unless otherwise agreed upon in the project.
✔ Clients receive full usage rights upon project completion and payment.
✔ Users must not infringe copyrights, trademarks, or intellectual property of others.

If you believe your work has been copied or used without permission, email legal@fikarix.com.

8. Privacy & Data Protection

✔ Fikarix collects and processes user data as per our Privacy Policy.
✔ Personal data is never sold to third parties.
✔ Users may request data deletion under GDPR and IT Rules, 2011 (India).

🚨 Data Security Compliance:

  • Fikarix follows GDPR (EU) & IT Act, 2000 to protect user data.
  • Users engaging in data breaches will be legally prosecuted.

9. Limitation of Liability

Fikarix is not liable for:
❌ Loss of business or profits due to service interruptions.
❌ Unauthorized use of user accounts.
❌ Third-party service failures (e.g., payment gateways).
❌ Legal issues arising between freelancers and clients.

🚨 Legal Compliance:

  • As per Indian Contract Act, 1872, Fikarix is not responsible for agreements made between users.

10. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any disputes shall be resolved under the jurisdiction of Bangalore, Karnataka, India.

🚨 International Users:

  • EU users are protected under GDPR.
  • US users must comply with CCPA.

11. Updates to Terms & Conditions

Fikarix reserves the right to update these terms without prior notice. Continued use of the platform constitutes acceptance of the revised terms.
